By creating an account or using the Skills. platform at myskillscard.xyz (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years old to use Skills. By using the Service, you represent that you are at least 13 years of age. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

You must provide accurate and complete information when creating your account. You are responsible for maintaining the security of your account credentials.

3. Your Account

You are responsible for all activity that occurs under your account. You agree to:

• Keep your password secure and confidential
• Notify us immediately if you suspect unauthorized access to your account
• Not share your account with others or allow others to access your account
• Provide accurate information in your profile and cards

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a security risk.

4. Your Content

You retain full ownership of all content you create and upload to Skills., including your card information, photos, videos, and any other materials ("Your Content").

By uploading or entering content into Skills., you grant us a limited, non-exclusive, royalty-free license to store, display, and serve Your Content solely for the purpose of operating and providing the Service to you and to people you share your card with.

You represent and warrant that:

• You own or have the rights to all content you upload
• Your content does not infringe the intellectual property rights of any third party
• Your content does not violate any applicable laws
• You have the right to grant us the license described above

5. Acceptable Use

You agree not to use Skills. to:

• Upload or distribute content that is illegal, defamatory, obscene, or harmful
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Send spam, unsolicited communications, or use lead capture features to harass others
• Upload malware, viruses, or any code designed to disrupt, damage, or gain unauthorized access to systems
• Violate any applicable local, state, national, or international laws or regulations
• Infringe on the intellectual property rights of others
• Collect or harvest personal information from other users without their consent
• Use the Service for any commercial purpose not expressly permitted by these Terms
• Attempt to gain unauthorized access to any portion of the Service or its related systems

6. Paid Plans and Billing

Skills. offers free and paid subscription plans. By upgrading to a paid plan, you agree to pay the applicable fees.

• Billing: Paid plans are billed monthly or annually as selected at the time of purchase.
• Cancellation: You may cancel your subscription at any time. Upon cancellation, your account will revert to the free plan at the end of your current billing period.
• Refunds: We do not offer refunds for partial billing periods. If you have a billing issue, contact us at myskillscard@gmail.com.
• Price changes: We reserve the right to change pricing at any time. Existing subscribers will be notified at least 30 days before any price increase takes effect.
• Plan limits: Each plan includes specific feature limits as described on the pricing page. We reserve the right to modify plan features with reasonable notice.

7. Public Cards

Your digital business card is publicly accessible to anyone with your card URL or QR code. By publishing a card, you understand and agree that:

• The information on your card is publicly visible on the internet
• Search engines may index your public card
• Visitors to your card may save your contact information
• You are solely responsible for the accuracy and appropriateness of your card content

You can pause or delete your card at any time from your dashboard, which will make it inaccessible to visitors.

8. Lead Capture and Visitor Data

If you use the lead capture feature, visitors to your card may submit their contact information. You agree to:

• Use collected lead data only for legitimate business purposes
• Not spam or harass visitors who submit their information
• Comply with all applicable laws regarding electronic marketing (including CAN-SPAM, GDPR, and CASL where applicable)
• Take responsibility for how you use and store lead data you export from Skills.

9. Intellectual Property

The Skills. platform, including its design, code, logos, and branding (excluding Your Content), is owned by Skills. and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our platform without our written permission.

The Skills. name, logo, and "Skills." mark are trademarks. You may not use them without our prior written consent.

10. Third-Party Services

Skills. integrates with third-party services including Google (Firebase, Google Sign-In), EmailJS, and Anthropic (AI features). Your use of these integrated services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third-party services.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any content on the Service.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SKILLS. AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless Skills. and its operators from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.

14. Termination

We may suspend or terminate your account at any time, with or without cause, and with or without notice, if we determine that you have violated these Terms or that termination is necessary to protect the Service, other users, or third parties.

You may terminate your account at any time by using the "Delete Account" feature within the app, or by contacting us at myskillscard@gmail.com.

Upon termination, your right to use the Service will immediately cease, and we will delete your account data as described in our Privacy Policy.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction in the United States.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, by sending an email notification. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
